Terms and Conditions
This page (including any documents it refers to) sets out the terms and conditions of Custom Soft Toys between you the consumer and us the business. By use of this site, including the use of any services offered and any transactions you place through this site; you agree to be legally bound to the terms and conditions as set out below. You should not use this site if you don’t accept our terms and conditions as outlined below.
The terms referred to as “we”, “us” or “our” in these terms and conditions relate to Custom Soft Toys and the terms referred to as “you” and “consumer” relate to yourself the end user who is interacting with Custom Soft Toys.
1) Age of consent
You must be at least 13 years old to use this website and interact with it.
2) Ordering products
By ordering any of the Products listed on this Website, you agree to be legally bound by these conditions. You will be unable to proceed with your purchase if you do not accept the current terms and conditions.
When you order one or more products from this site and procede through with a financial transaction, you will automatically enter a legally binding contract.
On completion of your order, you will receive an order number via email; please make a note of this reference in case you do not receive an email confirmation. An email confirmation will be sent following every order and it is your responsibility to ensure that your email address that you provide is correct.
Orders will normally be fulfilled and completed within 30 days from the date we accept your order, with the exception in rare cases where there are supply chain issues, in which case orders are likely to exceed 30 days to complete.
Ownership of the goods ordered will only pass to you when we receive full payment of all sums due in respect of them including any cost of delivery.
No order shall be deemed to be accepted by us until we issue an email acknowledgement. The contract between you and us will relate only to those goods and/or services notified in the email acknowledgement. The contract will end and cease when either the order is completed or the order is cancelled.
3) Personalised products
The products listed on this site are personalised and are made to order, you will not be able to return the product/s or receive a refund unless there is an obvious defect or fault with the product.
Due to the technical nature of lighting conditions and how technical devices display colours differently, items ordered from this site may look a different colour than what one perceives online; this is not a fault and you will not be able to return the product/s or receive a refund for this reasons.
Additionally and because individual items are handmade and personalised, all measurements are approximate. We endeavour to be as accurate and precise with measurements as possible.
4) Copyright
All content on this site (including the site it’s self and it’s designs) as well as any images, video or posts on 3rd party websites that are made by us, remain the legal right of either us or their respective owners and as such copyright is owned by the relevant parties
This includes the domain www.customsofttoys.co.uk, any sub domains of this domain and any email addresses associated with us.
Additionally mining, extracting and use of data from this site (Including photos and videos), whether manual or automated, is also prohibited.
Custom Soft Toys reserves the right to use it’s own photography of products it has created for marketing purposes. Any attempt to violate these conditions may result in legal action being taken against you.
5) Accuracy of data and information
We do our best to ensure that all of the information on our website and 3rd party social media pages is correct; however we cannot and will not be held accountable for genuine and honest mistakes.
6) Right to amend our terms and conditions and privacy policy
We reserve the right to amend our terms and conditions, our privacy policy, any part of our site, or any other element associated with our business at any time without prior notice.
It is your responsibility as the consumer to ensure you are aware of this and that you agree to the current terms and conditions and privacy policy when ever interacting with the business or site, including placing orders.

8) Shipment and postage
Our Website is only intended for use by customers resident in England, Wales, Scotland and Northern Ireland (the United Kingdom). We reserve the right to refuse to supply goods outside the UK where there is a valid business reason.
Where possible, we try to provide an estimate when your order will be delivered to you. The goods will be solely at your risk from the time of delivery.
As of 14th July 2023, postage to UK mainland is £5.99. Postage costs for shipments outside UK mainland will incur additional costs.
9) Product Types
We offer two categories of products:
Personalised products; what refers to physical items which are commissioned by you and are personalised and made-to-order goods.
Gift Certificate products; what refers to gift certificate based products what can then be used on this site to pay for or towards personalised products.
10) Prices
Prices as stated on our website and our official 3rd party social media pages include VAT and as such are the prices that you pay as an end user. Where there is an additional delivery cost, this will be made clear at the time of checkout.
We reserve the right to at any time update and amend the prices listed on our website and our official 3rd party social media pages.
11) Rights of Cancellation and Cancellation by us
In the rare event of fraudulent activity or other situations where you did not consent to placing an order, you may be eligible for order cancellation and a subsequent refund should we believe the case be genuine. This is at our discretion and judgement.
This does not impede that fact that products listed on this site are personalised and are made to order, and that under normal circumstances you will only be able to return the product/s and receive a refund if there is an obvious defect or fault with the product.
We also reserve the right to refuse to process a transaction for any reason, refuse service to anyone at any time, or to cancel a confirmed order at our sole discretion.
Additionally on the rare occasion, we may have to regrettably cancel orders that you the consumer places on this site for reasons what are outside out control and where we would be unable to fulfil the order or the .
With any cancellation, you will receive a full refund for any payment you have previously made including any postage that you have paid.
12) Liability
We will not be held liable to you or to any third party for reasons what are outside of our control, including transactions being suspended by the payment merchant (i.e. PayPal, VISA) after processing has begun. We will not be held liable to you or any third party by reason of so refusing or by reason of unwinding or suspending any transaction after processing has begun.
Additionally we will not be held liable where we are prevented from or delayed in carrying out contracts between you and us, due to circumstances beyond our reasonable control including and without limitation: acts of God, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, inclement weather, epidemic, lock-outs, strikes or other labour disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or an inability or delay in obtaining supplies of adequate or suitable materials. In such circumstances, the performance of our obligations shall be postponed for the period of time that the circumstances continue.
13) Gift Certificates
Gift certificates must be redeemed direct with Custom Soft Toys and are only valid on this site. Gift certificates have no value in legal tender.
Replacement of lost, damaged or stolen Gift Certificates is at the discretion of Custom Soft Toys and is subject to verification.
If an item purchased with a Gift Certificate is returned and where a refund would be due under our normal terms and conditions, then the refund will be given in the form of online credit against any further purchase on this site. No cash refund will be given in such case.
Gift Certificates will expire 1 year from the date of issue.
In the event of any dispute, the decision of Custom Soft Toys is final.
14) Your responsibilities as a consumer
Please check that the details contained in your order confirmation, any communication with us, and any details you submit and provide to the site are correct. We are not responsible for misspellings or other errors that result from information you supply.
15) Governing Law and Jurisdiction
The Website is controlled and operated in the United Kingdom.
Every purchase you make shall be deemed performed in England and Wales.
The Conditions and any Contract brought into effect as a result of usage of this Website will be governed by the laws of England and Wales and you irrevocably agree to submit to the exclusive jurisdiction of the courts of England and Wales.
